Copyright & DMCA Policy

The Bubble Art ("we," "us," "our") respects the intellectual-property rights of others and expects users to do the same. This Policy describes how we handle claims of copyright infringement and forms part of our Terms & Conditions.

1. Ownership & authenticity

Artists who list Artworks represent and warrant that they own or control all rights necessary to list and sell those Artworks and that the Artworks do not infringe any third party's copyright, trademark, publicity, privacy, or other rights. We do not independently verify authorship, originality, provenance, or authenticity, and Artists are solely responsible for the legality of their listings.

2. Prohibited content

You may not upload, list, sell, or distribute any Artwork or Content that infringes someone else's intellectual-property rights, that you do not have the right to use, or that misrepresents its authorship or origin. Listing plagiarized, stolen, or AI-laundered work that infringes another's rights is prohibited.

This includes fan art, unlicensed depictions of copyrighted characters, and unauthorized use of third-party trademarks or intellectual property, regardless of style, medium, or transformation.

3. Reporting copyright infringement (DMCA notice)

If you believe your copyrighted work has been used on the Services without authorization, you may send a written notice to our designated agent. Under the U.S. Digital Millennium Copyright Act (DMCA), your notice must include:

1. Your physical or electronic signature;
2. Identification of the copyrighted work you claim has been infringed;
3. Identification of the material you claim is infringing and information reasonably sufficient to locate it (such as the URL or listing);
4. Your contact information (name, address, telephone number, and email);
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

4. Our response

Upon receiving a valid notice, we will act expeditiously to remove or disable access to the allegedly infringing material and will make a reasonable effort to notify the user who posted it.

5. Counter-notice

If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notice to the same agent, including: your signature; identification of the removed material and its prior location; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your contact information; and a statement consenting to the jurisdiction of the federal court for your district (or, if outside the U.S., for any district in which we may be found) and that you will accept service of process from the complaining party. If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant files a court action.

6. Repeat infringers

We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of users who are determined to be repeat infringers, and we may remove content or accounts for any infringement at our discretion.

7. Misrepresentation

Under the DMCA, any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please be sure of your claim before submitting a notice or counter-notice.
